Daysie Privacy Policy

      Daysie is owned and operated by the National Science and Technology Development Agency (“NSTDA”, “we”, or “us”). In order to assure that appropriate security measures are provided in respect of your personal data, we provide this Privacy Policy (“Privacy Policy”, or “Policy”) to inform you of our practices regarding the collection, use and disclosure of your personal data.
      This Privacy Policy applies to the information and data we collect when you use our Site (such as www.daysie.io) and our Products, Services, and Software (collectively, the “Services”, or “Service”), or when you attend our event or otherwise interact with us. By using our Service, you agree to the collection and use of information in accordance with this Policy.
      “Users” or “you” may, depending on the context, be: a visitor to our Site or social media pages; a recipient of our communications; or an individual registered for our Services, including individuals who are provisioned an account by our customers (“Customers”).
1. Information and Data We Collect 
1.1. Personal Data
      While using our Service, we may automatically collect or ask you to provide us with certain personal data that can identify directly or indirectly to you as follows:
• Name and surname: When you register with our Service to create a user account, we may ask you to provide your name and surname in order to identify you.
• Email address: During registration, we may require you to provide us your valid, current email address for verification process.
• IP address: We collect your IP address when your browser contacts our servers to monitor and safeguard against overt activity that may affect overall quality of service of our users.
• Cookies: Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. Like many services, we use cookies to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. We use persistent cookies to save your username and password for future signing into our Service, and session ID cookies to enable certain features of the Service. Therefore, if you do not accept cookies, you may not be able to use some feature of our Service.
• Log data: We collect information that your browser sends whenever you visit our Service (“Log Data”). This Log Data may include information such as your computer’s IP address, browser type, browser version, the pages that you visit, the time and date of your visit, the time spent on those pages and other statistics.
This data is used to analyze trends, administer the Site, track user's movement on the Site (see which pages are of most interest etc), and gather broad demographic information for aggregate use.
      We do not collect any sensitive personal data that may expose you to unfair discrimination, e.g., racial or ethnic origin, political opinions, religious or philosophical beliefs, sexual orientation, criminal records, data relating to health and disability, genetic data, biometric data or any other data which affects you in such manner as prescribed.
1.2. Machine Learning Data via Google Drive
      User is responsible for sending User Materials to Daysie so Daysie can perform the Services. User represents and warrants (a) that it has the necessary rights, licenses, and permissions to provide the User Materials to Daysie and (b) that the use of User Materials under this Agreement will not violate or infringe the rights of any third party.
      We require you to login to your Google Drive account and allow us access to your Google Drive, browse files and folders, access and download your files in your Google Drive. Our use of your Materials in your Google Drive is limited to the practices explicitly disclosed in this Privacy Policy.
      We will download only your selected Google Drive file, and only the zip file will be extracted and used as a training dataset to perform transfer learning on our pre-trained Machine Learning model you have selected from our Machine Learning Service catalogue. If we find the downloaded file is of any other type, it will be erased, and the Service will prompt you to resubmit another valid zip file from your Google Drive.
      Upon every training session of a Machine Learning model, we will ask you explicitly if you will grant us the right to reuse one sample of your dataset and this particular Machine Learning model once it finishes training for our Service.
• If you grant us the right, we may put this model in our Machine Learning Service catalogue in the future and one sample point of your dataset that has been extracted from Google Drive zip file will be subsequently displayed as part of a description to the model. The rest of your training dataset will be immediately erased.
• If we opt to put your Machine Learning Model in our Machine Learning Service catalogue per your permission, the Model will be used for transfer learning only. It means that we will not permit other Users to export, download, copy your Model directly unless they perform transfer learning upon the Model using their own training data.
• Otherwise, all your Google Drive data that has been downloaded to our Service will be immediately erased, and the trained model will only be available in your Daysie User account for your exclusive use.
      We record your Google email and Google Drive tokens in session cookies in order to allow you to automatically log in to your Google Drive within a session time limit, which is 30 minutes. Once the session is expired, your record will be erased, and you will be asked to log in to your Google Drive again once you are required to download training dataset to our Machine Learning Service.
2. How We Use Your Information
Apart from the purpose of Service provision described above, we use your information for the following purposes:
2.1. Communication: We use your contact information to communicate with you about service updates and technical or administrative matters.
2.2. Event Organization: We use your personal information to plan and host events for which you have registered or that you attend, including sending related communications.
2.3. Public Relation: We process your personal information to send you information about our new Products and Services that may be of interest to you.
2.4. Service Improvement: We may use your information for improving our Service, and developing new Products and Services.
2.5. Legal Obligation: We will use your personal information where we reasonably believe that such action is necessary to (a) comply with applicable law, regulation, legal process, or government request, (b) protect any person from death or serious bodily injury, (c) prevent fraud, abuse, or security issue of Daysie or other users, and (d) enforce Terms of Service to protect Daysie’s or its licensors’ rights, property, safety, or interest.
      We may aggregate or de-identify information submitted to or collected by use of the Services so that the information does not identify you, for example to provide overall usage statistics of our Services.
3. Information Sharing and Disclosure
We do not sell or share personal data and service data with other third parties except in the following cases:
3.1. With your consent: We will share your Machine Learning Model only when we have your consent. Other personal and service data will not be kept private to your account.
3.2. Legal and regulation obligation: We may share your data if we reasonably believe that such action is necessary to (a) comply with applicable law, regulation, legal process, or government request, (b) protect any person from death or serious bodily injury, (c) prevent fraud, abuse, or security issue of Daysie or other users, and (d) enforce Terms of Service to protect Daysie’s or its licensors’ rights, property, safety, or interest.
3.3. Acquisition or reorganization: In case of an acquisition or reorganization, we may sell or transfer your information in connection. However, we will use commercially reasonable efforts to notify you in advance.
4. Deletion and Retention of Data
      Service Data is deleted once it is no longer needed. For each type of data and operation, the retention period is set based on the purpose of its collection to ensure that it is not kept longer than necessary. We may need to retain certain personal information for an extended period of time for business or legal purposes, such as your email address and your usage data that may be used for Service analysis and improvement purposes.
5. Your Privacy Rights and Choices
      Your consent given to us for collection, use and disclosure of your data shall remain valid until you withdraw your consent in writing. You may withdraw your consent or suspend the use or disclosure of your data for the purposes of any or all of our activities by submitting such request in writing to NSTDA or via email to dpo@nstda.or.th
Other than the above rights, you are also be entitled to proceed as follows:
5.1. Withdraw consent: You have the right to withdraw consent to the processing of your data given to us at any time during the period your data is kept with us.
5.2. Access: You have the right to access your data and request to make a copy of such data, as well as request us to disclose how your data was collected without your consent to us.
5.3. Rectification: You have the right to request us to rectify any incorrect personal data or add any incomplete personal data.
5.4. Erasure: You have the right to request us to erase your data for certain reasons.
5.5 Restriction of processing: You have the right to restrict the use of your data for certain reasons.
5.6. Portability: You have the right to require us to transfer your personal data or service data provided by you with us to another data controller or third party for certain reasons.
5.7. Objection: You have the right to object the processing of your personal data for certain reasons.
      We respect your decision to withdraw your consent. However, there may be certain restrictions to your right to withdraw consent by law or contract. The withdrawal of consent shall in no way affect the collection, use or disclosure of the data previously provided with your consent.
6. Security
     We provide appropriate security measures to prevent any unauthorized or undue access to, use, change, rectification or disclosure of your data. Moreover, NSTDA has set out its internal practice for authorization of access to or use of User’s data in order to keep such data confidential and safe. We will review such measures from time to time as appropriate. However, no method of transmission over the Internet or electronic storage is 100% secure. Therefore, we hereby inform you that we cannot guarantee its absolute security.
7. Modifications
      We may update or revise our Privacy Policy without advance notice so as to be appropriate and efficient in the provision of Services. Therefore, we advise you to read the Privacy Policy every time you visit or uses our Services or Site. However, if we make any material changes to these Policy, we will use commercially reasonable efforts to notify you.
